New Zealand Post Workers Win Could Boost Others'... | Stuff.co.nz

A Court of Appeal decision over posties' holiday pay could have significant implications for staff working irregular overtime, an employment lawyer says.

The court determined NZ Post was obliged to calculate and pay posties for unrostered overtime when paying them for public holidays, holidays in lieu or leave for bereavement or sickness.

In doing so the court overturned decisions by the Employment Court and the Employment Relations Authority, which had been appealed by the Postal Workers Union of Aotearoa.

Chen Palmer partner Susan Hornsby-Geluk said the ruling would affect any employee who worked irregular overtime, such as police, nurses and people in the service industry.

"The employer has to pay them their average daily rate, which is averaged out over the whole year, as opposed to just what they might have been rostered on to work."

Affected employers could find their wage bill increased "quite substantially", with employees able to claim wages owed up to six years in arrears under the Holidays Act.

"NZ Post is a significant employer with access to good legal advice and they weren't doing it right. I would anticipate there would be a significant number of employers who would not be paying in accordance with this decision."

Jennifer Mills and Emma Warden, partner and senior associate at Minter Ellison Rudd Watts, said the decision would have ramifications for employers and staff but its impact should not be overstated.

The Employment Court ruled that an employee had to establish that they would have worked overtime on the day in question and the amount they would have received in order to be paid for it.

But Graeme Clarke, advocate for the Postal Workers Union, said that was near impossible as in most cases a postie would not know if they had to work overtime until the day itself.

Quick note: For now we just have lots of rain and a few wind gusts thanks to Hurricane Sandy, but things are supposed to get a bit rougher later today and tomorrow so we expect to be without power for a while (although we?ll post remotely whenever we can). We hope everyone else is staying safe and dry!

Since pegboards are my new favorite thing, you knew I was bound to write another basement organization post that mentions them (along with some other methods to contain/control things like screws and nails) right? Especially since it gave me an excuse to embed one of my all-time favorite Target Lady sketches from SNL:

But enough Justin Timberlake. Her?s how I brought some sexy back to the basement (which I recently started to clean up after a yard sale, a bagster pickup, and some yard tool organization).

Next up on the organization to-do list were my regular tools. We actually made the decision to relocate most of our tools to the basement after years of being weirdos who stored them in our kitchen drawers. We?ll still keep duplicates of a few popular items -?like hammers, nails, and caulk ? in our sunroom (where everything?s been living most recently) but having the rest of our arsenal neatly hung/stored in one place (aka: the basement workshop) definitely outweighs the extra trouble of walking down to the basement now and then to get a few things.

So we began this phase of basement org by trucking everything down (i.e. drawers, toolbox, etc) to the basement so I could begin sorting. Forgive the sucky pictures. Sherry was using the camera for another project so I was stuck taking phone pics.

First I spread everything out on the work table to see what I had and how I might categorize everything.

Going through everything was kind of a weird, sentimental walk down memory lane. It was just so funny to see old items that were hanging around after projects from the past, like our old kitchen knobs and the clothespin chandelier that we made.

How could we forget those eyeball-ish kitchen knobs?

I also found tools with some memories behind them. Like the Boy Scout pocket knife passed down from my Papa (sidebar: I was the first in the line of my male cousins on my mom?s side NOT to become an Eagle Scout. I started and stopped right at Cub Scout. #blacksheep). And there was the first set of screwdrivers that my dad gave me back in high school (at the time I?m sure I accepted them with some sort of angsty ?when will I ever use these stupid things??? type of look).

My dad actually gave me those screwdrivers along with the toolbox below, which traveled with me to college and even to New York ? although for most of its lifespan it has held a measly three or four tools. But one reason I?ve kept it is because my dad taped a picture of his family inside. The couple on the right is my grandfather Emanuel and his second wife Helen. His first (my dad?s mom) died when my dad was young. She?s the Clara that our bean is named after.

But enough sentimental stuff. On to the pegboard! After a couple of hours (and a trip to Home Depot to buy a set of pegboard hooks) my tools finally looked like they always should have: orderly and ready to go.

Here?s a couple of closer shots for ya, in case you?re like me and enjoy staring at pegboards full of tools for extended periods of time.

This actually isn?t everything. We decided to keep paint & craft supplies (i.e. glue gun, staple gun, etc) upstairs in the sunroom along with a few other essentials (like picture nails and anchors, along with a hammer and caulk) since we tend to use them more in the house than in the workshop. And I stashed a lot of my project-specific tools in the toolbox (finally it?s getting use!) so I know that?s where to go when I need plumbing or electrical supplies.

I could stare at those pegboards all day. But then I wouldn?t get any actual work done. And sadly I still had this crazy drawer full of screws, nails, and other hardware that was crying out for help.

So I used a similar process to sort them. First I spread everything out on the table and started grouping similar items. Then those similar items went into mason jars together.

I actually had a bunch of mason jars sitting around from a failed project Sherry tried taking on. She was going to repackage our vacation time capsules into smaller jars? but realized too late that the stout new jars that she bought obscured the items inside too much (so taller mason jars like the ones we used originally actually work best). So the too-short jars got passed down to me after she had already spray painted the silver tops a cool midnight blue color. Lucky me.

But Sherry?s pint-sized hand-me-downs weren?t quite enough for my sprawling assortment of screws, so I did have to invest in some (even smaller) half-pint jars myself (from JoAnn with a 50% coupon).

Here?s everything once it had found a jar to call home. Don?t mind the pieces of paper sticking out of them. Those were labels from the hardware packaging that I hung on to so I could remember what was what (since I planned to hand-write my own labels later).

Once everything was labeled and canned, I stuck them up on this shelf that the previous owner had built in above the work surface (don?t mind the edge that looks like it was once on fire ? we plan to stain it all soon).

The shelf spacing is a bit much for these tiny cans, but it?s not worth rebuilding the shelves or anything, so I?m just happy they?re here to house my collection.

As for the labels, I just bought some 1.5 x 1.5? square Avery labels at Staples for a few bucks and hand wrote the info on the front. I debated printing them on the computer to make them look slightly fancier, but I figured that was a system I?d never keep up with.

Eventually I hope to take these two projects a step further by painting the pegboards and staining the shelf as I mentioned (along with some other items in the room like the built-in work table). We think that?ll really help pull things together and make it look a little more workshop-swanky as opposed to old-ignored-basement. I don?t think I?m going to go too over-the-top with things in the basement just because I like to be realistic about what?s worth my time and what?s easiest to maintain over time. Which is why I?ve decided to pass on the idea of outlining my tools on the pegboard, since I feel like it?ll just create frustration when I have to add or subtract a tool and don?t want to repaint the whole thing. But who knows, I could change my tune someday (Sherry mentioned chalk outlines since those are easily changed, but we don?t want chalk dust all over our stuff so we later both dismissed that option).

I was just grateful that the drawers I was bringing back upstairs to the sunroom were looking much more clutter free. So these are the items we kept upstairs since we think we?ll use them more up there while the rest makes more sense to keep together in the workshop.

And while my newly organized tools and hardware supply was making me quite confident about how the basement was shaping up, let us be reminded that I still have this to deal with: the wall o? paint, spray paint, and other buckets. But that?s a project for another day?

Okay, so who has a pegboard obsession? Is anyone else planning to paint and stain things in the basement for a little more of a finished look? Do you have a hard time figuring out which tools should stay out in the garage, basement, or attic and which ones should be inside and easy to grab? I gotta admit that once we spent a few minutes thinking about what we use upstairs vs. what we use in the workshop it really wasn?t too tough to commit to keeping stuff in the areas that make the most sense.

Giants sweep Tigers for World Series title

DETROIT ? The end came much like this series, not with a boom, but with a little fly ball that fell through the 10th inning raindrops and onto the Comerica Park outfield grass for a single that would win the San Francisco Giants the 2012 World Series.

In a series where new heroes come nightly and from a roster of anonymous names, the star would be second baseman Marco Scutaro, whose fly ball fell in front of Detroit Tigers center fielder Austin Jackson. It scored journeyman infielder Ryan Theriot, who slid across home plate for what would be the winning run in a 4-3 victory in Game 4 on Sunday night.

(AP)And after closer Sergio Romo struck out Miguel Cabrera for the final out, the Giants raced to the center of the infield to celebrate their second World Series championship in three years. It's the franchise's seventh world title.

Pablo Sandoval was voted World Series MVP after batting 8 for 16 in four games, doing most of his damage in Game 1 with a historic three home run performance.

"My mom sent me a text and said don't wake up," Sandoval said of his dream-come-true World Series.

As for the other big hitter entering this series, it was fitting that Cabrera was the final out Sunday. After all, it was the failure of Detroit's big hitters, primarily Cabrera and Prince Fielder, that led to the Tigers' demise in this series. Their silence had as much to do with San Francisco's sweep as the Giants' resourcefulness.

In dispensing praise, Giants manager Bruce Bochy had a big helping for Romo, who seized the closer role in place of the injured Brian Wilson.

"Sergio, he's the guy you want out there. He's not afraid," Bochy said. "He saved us all year when we lost [Brian] Wilson."

Like they have in this World Series, the Giants scored first Sunday. Only unlike the other games, they couldn't hold onto the lead. Hunter Pence hit a fly ball in the second inning that rose high toward center field and carried over the heads of the outfielders before finally bouncing on the warning track and dropping over the fence for a double. The next hitter, Brandon Belt, hit a fly ball down the right-field line that smacked against the fence. By the time the Tigers got the ball back to the field Belt had a triple, Pence had scored and San Francisco was up 1-0.

The lead disappeared an inning later when Austin Jackson walked and two batters later Cabrera hit what appeared to be a routine fly ball to right field that got caught in the roaring wind and carried until it disappeared in the crowd for the Triple Crown winner's first home run of the World Series.

For Detroit, though, the problem was that pitcher Max Scherzer couldn't hold the 2-1 lead. In the top of the sixth he gave up a single to Scutaro and then two batters later he got a 1-0 changeup over the middle of the plate and Giants catcher Buster Posey pulled it down the left-field line. The ball curled just inside the foul pole for a home run that sent the San Francisco players running and jumping in their dugout.

The 3-2 lead lasted two batters into the bottom of the inning when Delmon Young hit a home run to right to tie the score 3-3, where the game would be stuck until Theriot and Scutaro won it in the 10th inning.

"It was freaky. I would've never guessed it," Tigers manager Jim Leyland said of his team's inglorious demise in a postgame TV interview. "There was nothing flukey about it."

Five Essential Tips for A Successful Seasonal Cleanse. {Bonus ...

It might sound lame, but the first thing that came to my mind when I signed up for an online detox was losing the final extra five (or so) stubborn pounds.

I am not sure why most of my female friends and students think they need to lose any pounds, but nonetheless?I?ve?been working hard to cultivate mindfulness and positive change in my life?s patterns, ever since I embarked on the path of ?transformation as a yoga student.

But, sometimes the old patterns (samskaras) do resurface?and just like weeds in my garden, recently two of these not-so-healthy patterns?kleshas (obstacles)?came into full bloom once again.

One of the kleshas is to overload on activities.

I had barely learned how to ride a bike when, instead of my planned 10 minute journey, I ended up cycling for three solid hours, only to tumble off the bike and hurt one of my chest muscles. My accident?left me sore and not able to do anything active for a while?not clever!

Anyway, with lots of practice,?I?ve?been learning how to work with my injuries and adjust my routine?as I?m sure many of you have experienced, however, the second I stop exercising, I find myself indulging in mindless self-pity?my second klesha.

With all that happening in my life, the time to cleanse was perfect!

Don?t get me wrong, the body has a robust mechanism for cleansing and digesting; it?s just that we tend to overload ourselves with toxic air, food, products and thoughts.?So, if you have never cleansed before, I would recommend an easy cleanse to start with.

Please consult your doctor if you have any health issues; and you should definitely educate yourself as much as you can and do your own homework, before you get started on a program.

Another very important part to cleansing is to keep reflecting on how you feel throughout the cleanse and adjust what you?re doing accordingly.

The cleansing guidelines below were adapted from Vixi?and remixed by me.

1) Intention

Most important of all is to have a clear intention to help you steer clear of distractions. Also, it?s wise to give yourself a few days before and after to ease gently into and emerge out of detox.

Tools:?

* Blender
* Juicer
* Pressure Cooker

Products:

* Epsom Salt
* Body Brush
* Coconut Oil
* Tongue scraper

2)?Preparation (aka the grocery list)

The on-line program provided the grocery shopping list; in addition, I made use of any seasonal veggies and fruits I already had lying around.?Most of the juices require cucumbers, celery and apple as a base but on top of that I had fun mixing a variety of veggies and experimenting.

One of the most important functions in our body is digestion.?As Ashley mentioned during her program, most people skip this step?but when it comes to the ability to digest food, our food habits are just as important as our food choices. The deliberate actions of slowing down, remaining present, eliminating distractions and saying grace increase the body?s ability to fully digest what we?re eating.

It also allows us to focus on the sensations of hunger or fullness?ideally, we want to eat only until we feel 3/4 full.?As you?re probably picking up, cleansing is basically just like the practice of yoga!

3)?Establishing daily rituals

* Wake up a bit earlier than you normally do (as part of your practice). Ideally, I would recommend as early as five-to-five-thirty in the morning, but I can see for some people this could be a bit too early. So, depending on your schedule, just make sure you allow yourself some time before you rush out of the door.

* Dry brushing/oil massage

* Drink one liter of lemon water upon waking; for a change, try mixing it with two tablespoons of crystal pink salt

* Eat at the same time every day

4) Morning yoga?practice

I strongly believe that your practice should be individualized. It is much better to do less than more, as long as it?s daily.?Yoga practice should be well-rounded (i.e.: asana (physical), pranayama?(breathing) and the appropriate meditation). Consult your teacher to find the right balance (doing very different things day-to-day?isn?t?the best way to care for your mind).

5) Winding down

Wind down with an Epsom salt bath; run a bath at room temperature, mix in two cups of Epsom salts and soak for 15 minutes.

Before bed, take about 15 minutes to journal your thoughts?this?doesn?t?have to be a long process, just notice whatever comes to mind and do a short meditation practice (again, this is best provided by a teacher).?Try to go to bed no later than 10pm to really make the most of your beauty sleep.

Here are a few sample detox recipes, adapted from?Vixi:

Green Juice?Breakfast: Green juice, 9am: 16 to 20 ounces of Urban Zen:

*two-three large romaine leaves
*two leaves kale
*one green apple
*one stalk fennel
*one stalk celery
*one cucumber
*? yellow pepper
*three oz baby spinach

Mid-morning pick-me-up (around 11 am): 16 to 20 ounces of?Happy Buddha:

*four large carrots
*two oranges, peeled
*one lime, peeled
*? inch ginger
*six mint leaves

And lastly, I really enjoyed my very own signature, easy-to-make soup (around 6pm):

*one sweet potato

*? cup of quinoa

*one cup of vegetable stock

*one stalk celery

*one stalk parsley

I used the pressure cooker to make it?but if you like, you can mix all the ingredients in a pan, bring to boil, simmer for 30 minutes and garnish with parsley.

Not only was I able to lose my extra five pounds, I used this time to take care of my injury, give myself some space to chill out and allow myself some time to properly digest the move.

It?s nearly November, but hopefully this week?s top iOS apps won?t leave you out in the cold. Leading off is Brian Cox?s Wonders of the Universe, a fascinating app for space and science geeks that offers a multimedia tour from earth to the edge of the known universe. Others include a translation app, the iPhone debut of a classic magazine, an update to a music-streaming app and a new automatic task-scheduling app.

It?s easy to forget there?s a whole universe out there, but with Brian Cox?s Wonders of the Universe app you?ll never forget how vast and crazy space can be. Wonders of the Universe offers a 3D tour of the cosmos, complete with info on galaxies near and far, going all the way to what the app calls ?the edge of the known universe.? The app has more than 200 interactive articles and nearly three hours of videos from the BBC TV series ?Wonders of the Solar System? and ?Wonders of the Universe.? Finally, the app has hundreds of photographs of various objects in space.

Russian tycoon to ditch business for politics

MOSCOW (AP) ? Billionaire New Jersey Nets owner and former Russian presidential candidate Mikhail Prokhorov said Saturday he's leaving business to focus full-time on politics, returning to the political arena after remaining silent through a five-month Kremlin crackdown on the opposition.

The 47-year-old Prokhorov, who is believed to be worth about $13 billion, finished third in Russia's presidential election in March amid speculation that his candidacy was orchestrated by the Kremlin. Coe reveals Olympic fears that kept him awake at night

LONDON (Reuters) - London Olympics organising committee chairman Sebastian Coe had sleepless nights worrying about possible terrorist attacks during this year's Games, according to his autobiography to be published next month.

Coe, 56, who exuded calm and confidence as the chairman of the committee that organised the hugely successful Games in July and August, tells of his concerns that kept him awake at night.

"I was less concerned about a Twin Towers scenario because there were missiles on tower blocks and Navy Seals in exercise boarding boats on the Thames," he writes in extracts published by The Times on Saturday.

He says though, he was haunted by a "lone wolf" terrorist attack.

"I was haunted by the fear of that when people were celebrating having street parties or watching TV screens in pubs ten deep. That fear never left me.

"I counted off the days, counted off the hours."

In his book he describes meeting Chris Allison, the assistant commissioner of the Metroplitan Police a few days before the Games ended.

"We didn't even need to say what we were thinking. We just looked at each other and I said: 'This isn't done until we've got everybody home safely.' And he said, 'Yeah, I know'."

In an interview with The Times, Coe says he was sitting with his sons in the Olympic Stadium on the last night of the Paralympic Games when it suddenly occurred to him that the venture that had dominated his life for the last 10 years was over.

After the closing ceremony had ended, his sons asked if they could go down on to the track. Thinking of lots of bureaucratic reasons why they could not he was just about to say "no," when he realised it did not matter any more if they did.

He went down to the track with them and said: "As we stood there, it was instinct. I just pulled them both into a huddle and thanked them for the last 10 years."

Asked if he felt guilty at not being around for his young family, he said, "Yes absolutely it was an obsession."

Coe, who won the 1,500 metres gold medal at the 1980 Olympics in Moscow and the 1984 Games in Los Angeles is unopposed in the election for chairman of the British Olympic Association on November7.

His book, "Running My Life - The Autobiography" is due to be published the following day.

WASHINGTON (AP) ? Former Secretary of State Colin Powell, a longtime Republican, is sticking with President Barack Obama in this year's election.

He told CBS' "This Morning" he respects fellow Republican Mitt Romney but thinks he's been vague on many issues.

Powell said the president got the United States out of Iraq, has laid out a plan for leaving Afghanistan "and didn't get us into any new wars."

He praised Obama's economic performance, saying, while difficult choices are ahead on taxes, spending and budgetary policies, "steadily, I think we've begun to come out of the dive and we're gaining altitude."

Obama later called Powell to thank him.

Powell, a retired general, was also a White House national security adviser and chairman of the Joint Chiefs of Staff.

New study brings a doubted exoplanet 'back from the dead'

ScienceDaily (Oct. 25, 2012) ? A second look at data from NASA's Hubble Space Telescope is reanimating the claim that the nearby star Fomalhaut hosts a massive exoplanet. The study suggests that the planet, named Fomalhaut b, is a rare and possibly unique object that is completely shrouded by dust.

Fomalhaut is the brightest star in the constellation Piscis Austrinus and lies 25 light-years away.

In November 2008, Hubble astronomers announced the exoplanet, named Fomalhaut b, as the first one ever directly imaged in visible light around another star. The object was imaged just inside a vast ring of debris surrounding but offset from the host star. The planet's location and mass -- no more than three times Jupiter's -- seemed just right for its gravity to explain the ring's appearance.

Recent studies have claimed that this planetary interpretation is incorrect. Based on the object's apparent motion and the lack of an infrared detection by NASA's Spitzer Space Telescope, they argue that the object is a short-lived dust cloud unrelated to any planet.

A new analysis, however, brings the planet conclusion back to life.

"Although our results seriously challenge the original discovery paper, they do so in a way that actually makes the object's interpretation much cleaner and leaves intact the core conclusion, that Fomalhaut b is indeed a massive planet," said Thayne Currie, an astronomer formerly at NASA's Goddard Space Flight Center in Greenbelt, Md., and now at the University of Toronto.

The discovery study reported that Fomalhaut b's brightness varied by about a factor of two and cited this as evidence that the planet was accreting gas. Follow-up studies then interpreted this variability as evidence that the object actually was a transient dust cloud instead.

In the new study, Currie and his team reanalyzed Hubble observations of the star from 2004 and 2006. They easily recovered the planet in observations taken at visible wavelengths near 600 and 800 nanometers, and made a new detection in violet light near 400 nanometers. In contrast to the earlier research, the team found that the planet remained at constant brightness.

The team attempted to detect Fomalhaut b in the infrared using the Subaru Telescope in Hawaii, but was unable to do so. The non-detections with Subaru and Spitzer imply that Fomalhaut b must have less than twice the mass of Jupiter.

Another contentious issue has been the object's orbit. If Fomalhaut b is responsible for the ring's offset and sharp interior edge, then it must follow an orbit aligned with the ring and must now be moving at its slowest speed. The speed implied by the original study appeared to be too fast. Additionally, some researchers argued that Fomalhaut b follows a tilted orbit that passes through the ring plane.

Using the Hubble data, Currie's team established that Fomalhaut b is moving with a speed and direction consistent with the original idea that the planet's gravity is modifying the ring.

"What we've seen from our analysis is that the object's minimum distance from the disk has hardly changed at all in two years, which is a good sign that it's in a nice ring-sculpting orbit," explained Timothy Rodigas, a graduate student in the University of Arizona and a member of the team.

Currie's team also addressed studies that interpret Fomalhaut b as a compact dust cloud not gravitationally bound to a planet. Near Fomalhaut's ring, orbital dynamics would spread out or completely dissipate such a cloud in as little as 60,000 years. The dust grains experience additional forces, which operate on much faster timescales, as they interact with the star's light.

"Given what we know about the behavior of dust and the environment where the planet is located, we think that we're seeing a planetary object that is completely embedded in dust rather than a free-floating dust cloud," said team member John Debes, an astronomer at the Space Telescope Science Institute in Baltimore, Md.

A paper describing the findings has been accepted for publication in The Astrophysical Journal Letters.

Because astronomers detect Fomalhaut b by the light of surrounding dust and not by light or heat emitted by its atmosphere, it no longer ranks as a "directly imaged exoplanet." But because it's the right mass and in the right place to sculpt the ring, Currie's team thinks it should be considered a "planet identified from direct imaging."

Fomalhaut was targeted with Hubble most recently in May by another team. Those observations are currently under scientific analysis and are expected to be published soon.

Syria says army still undecided on ceasefire move

BEIRUT/CAIRO (Reuters) - Syria said on Wednesday its military command was still studying a proposal for a holiday ceasefire with rebels - contradicting international mediator Lakhdar Brahimi's earlier announcement that Damascus had agreed to a truce.

The statement threw Brahimi's efforts to arrange a pause in the bloodshed in Syria into even more confusion, as the rebels fighting to topple President Bashar al-Assad have given no indication they would be willing to sign up to it.

A previous ceasefire arrangement in April collapsed within days, with both sides accusing the other of breaking it.

Brahimi, the joint U.N.-Arab League special envoy, had crisscrossed the Middle East to push the warring factions and their international backers to agree to a truce over the Muslim holiday of Eid al-Adha - a mission that included talks with Assad in Damascus at the weekend.

"After the visit I made to Damascus, there is agreement from the Syrian government for a ceasefire during the Eid," Brahimi told a news conference at the Arab League in Cairo.

Within an hour, Syria's Foreign Ministry said the proposal was still being studied by the armed forces' leadership. "The final position on this issue will be announced tomorrow," a ministry statement said.

The holiday starts on Thursday and lasts three or four days. Brahimi did not specify the precise time period for a truce.

Nor did the initiative include plans for international observers and rebel sources had earlier told Reuters there was little point if it could not be monitored or enforced.

The two sides are now locked in a battle with huge potential ramifications in the northwest.

Syrian warplanes carried out bombing raids on Wednesday on the strategic northern town of Maarat al-Numan and nearby villages while rebels surrounded an army base to its east, an activist monitor said.

Five people from one family, including a child and a woman, were killed in the air strikes, according to Rami Abdelrahman, head of the British-based Syrian Observatory for Human Rights.

Maarat al-Numan has fallen to the rebels, effectively cutting the main north-south highway, a strategic route for Assad to move troops from the capital Damascus to Aleppo, Syria's largest city where the insurgents have taken a foothold.

But without control of the nearby Wadi al-Daif military base, their grip over the road is tenuous. Its capture would be a significant step towards creating a "safe zone" allowing them to focus forces on Assad's strongholds in southern Syria.

The rebels say the ferocity of counter-attacks by government forces shows how important holding the base is to Assad's military strategy.

Opposition activist footage on Wednesday showed a column of grey smoke rising after a bomb hit the village of Deir al-Sharqi, a few kilometers (miles) south of the base.

REFUGEES FLEE BOMBARDMENTS

Meanwhile, hundreds of Syrian refugees have poured into a makeshift refugee camp at Atimah overlooking the Turkish border, fleeing a week of what they said were the most intense army bombardments since the uprising began.

"Some of the bombs were so big they sucked in the air and everything crashes down, even four-storey buildings. We used to have one or two rockets a day, now for the past 10 days it has become constant, we run from one shelter to another. They drop a few bombs and it's like a massacre," one refugee, a 20-year-old named Nabil, told Reuters at the camp.

The army has lost swathes of territory in recent months and relies on air power and heavy artillery to push back the rebels fighting to topple Assad.

More than 32,000 people have been killed in the conflict, which began with peaceful pro-democracy protests in March 2011 before descending into civil war as repression increased.

Human Rights Watch said the Syrian air force had increased its use of cluster bombs across the country in the past two weeks. The New York-based organization identified, through activist video footage of unexploded bomblets, three types of cluster bombs which had fallen on and around Maarat al-Numan.

Cluster bombs explode in the air, scattering dozens of smaller bomblets over an area the size of a sports field. Most nations have banned their use under a convention that became international law in 2010, but which Syria has not signed.

Russia said on Wednesday the rebels had acquired portable surface-to-air missiles including U.S.-made Stingers - a weapon that would help bring down warplanes and helicopters which have bombed residential areas where rebels are hiding.

Opposition activist footage has shown rebels carrying Soviet-made surface-to-air missiles, but footage of Stingers has yet to appear.

In contrast to the Libya crisis last year, the West has shown little appetite to arm the Syrian rebels, worried that weapons would fall into the hands of Islamic militants.

Russia, which has supported Assad through the conflict, sold his government $1 billion worth of weapons last year and has made clear it would oppose an arms embargo in the U.N. Security Council.

A total of 190 people were killed across Syria on Tuesday, the Observatory said.

The president's statement appears to undercut what has been?a Senate Democratic negotiating strategy: to use the threat of the sequester to leverage concessions from Republicans on raising taxes on Americans with the highest incomes. GOP leaders said they were surprised by the announcement, especially as the president has yet to present a plan to avoid the sequester.

Moreover, the presidential campaign has failed to prepare the American public for tough choices that face the newly elected president and Congress immediately after the Nov. 6 election.

The cliff, a term coined by Federal Reserve Chairman Ben Bernanke, includes the expiration of the Bush-era tax cuts for all Americans, sharply lower payments for health-care providers for Medicare patients, and the sequester, which will indiscriminately slash budgets at the Defense Department and non-defense expenditures like social services and education, among other issues.

That hit, the Congressional Budget Office (CBO) estimates, is likely to send the US economy into a recession. And while Congress may do what it does best ? put the issue off for some time before scampering home for Christmas break ? that route is fraught with peril from bond-ratings agencies threatening to downgrade America?s credit rating should Washington again cop out of its financial responsibilities.

?There?s really been no discussion of the elephant in the room,? says Marc Goldwein, a senior policy director at the Committee for a Responsible Federal Budget, a nonpartisan group that advocates fiscal responsibility. ?I?m not sure [the fiscal cliff is] our biggest threat, but it?s our most immediate threat to the economy.?

That lack of discussion could be troublesome for whichever man is elected on Nov. 6, as weighty choices about taxes and spending must be made quickly ? and without laying the groundwork or obtaining a mandate from voters for moving a deal through Congress.?

?Talking about it, you emphasize, ?It?s really a problem,? ? says Douglas Holtz-Eakin, a former CBO director and the chief economic policy adviser for Sen. John McCain?s presidential run in 2008. ?The American people need to know it?s really a problem.?

Both Romney and Obama have laid out their plans for handling America?s overall debt and deficit in broad terms, including accepting the claim by bipartisan, blue-ribbon panels that the nation needs to trim its debt by some $4 trillion over the next decade.

Is Tuesday a Productive Day for You? : Ideas For Women Health ...

Health and mental health are vitally important to women especially those who work outside the home. Tuesdays can be the most productive day of the week for some women due to these facts.

Mondays may be catching up from all that you didn?t finish on Friday, Saturday, or Sunday. Mondays can leave you exhausted still especially if you have children who are in sports and school activities. Many school practices and open houses are on Monday nights leaving you feeling like you are on an endless treadmill to no where.

Tuesdays however can be the day where you finally feel somewhat rested and it is the eve of midweek improving your overall mental attitude. Tuesdays can be the most productive day of the week.

Plan your meals for the rest of the week. Make a list of the things that still need to be done or are still on the calendar for the rest of the week. Do laundry for those items you want to wear at the end of the week or on the weekend. Make those business or social phone calls on a Tuesday so people can adjust their own calendars to meet your needs.

The thing that makes most women feel inadequate is over scheduling. Over scheduling children and self can be dangerous for the health of the family. Have a family meeting if you feel that your family is too busy to connect. Ask for help from family members to make meals or do laundry, tidy up the bathroom or do household chores. Helping each other during the week will ease up what needs to be done on the weekend so everyone can enjoy some down time.

Walk the Talk: Four Tips to be an Extraordinary Leader

?Thomas J. WalterIt?s common knowledge that there are two kinds of leaders, those who speak and those who do. Those who speak are referred to as ?vocal leaders,? and those who do are referred to as ?servant leaders,? though the title of the latter is frequently off-putting to business leaders of self-proclaimed high stature.

While leaders with excellent communication and motivational skills are often praised for these skills, they?re not the only component to being an effective leader. It?s the servant leadership that I?m most frequently hard-pressed to find.

Rising to a certain level of leadership in an organization often comes with a self-righteous attitude that beats to the tune of, ?I?ve got people who can take care of that for me now.? In many cases, that is a legitimate response?certain job titles and responsibilities can?t afford to take care of tasks that once occupied their time. However, over-delegation is a disease that starts at the top and spreads through any collection of people working toward a common goal. It pollutes the leader?s image in the minds of his or her employees, as well as sets precedence for that type of behavior at all levels of the organization.

What?s so often missing in a dynamic leadership setting is a leader who does extraordinary things. Leaders who do extraordinary things lead by example, or ?walk the talk,? as we businesspeople love to say. Those leaders believe in servant leadership and practice it daily, and they are the ones to whom their employees look up to?not out of fear or intimidation, but with respect and admiration. They are the leaders that people want to follow. They are the ones who take their organizations beyond engagement to a state of entanglement, where employees are so connected to the success of their organization that its goals become synonymous with their own.

Saying all of this wouldn?t mean much if I didn?t give a set of steps that leaders could take to improve their servant leadership. Here are some ways to work on developing the servant leadership component of your leadership skills:

They eat, then you eat. They sleep, then you sleep.
This is a somewhat ignored thought process in the business world, which often values a hierarchal pecking order. Leaders should put employees? needs before their own. Part of being a servant leader is sacrifice. The team comes first, not your ego.

Do the dirty work.
Take care of the things that get in the way of your employees? ability to give 100 percent. For example, money is often a leading cause of anxiety. Our company, Tasty Catering, developed an employee assistance fund to make it easier and faster for employees in need to borrow money. By removing the distraction caused by monetary hardship, employees can better remain focused on work. They can spend their discretionary thinking on their organization and job performance as opposed to the troubles that await them when they get home.

Show me you love me.
Show (not tell) that you care for everyone in the organization and that everyone plays a vital role in how the organization will function. You didn?t climb your way to the top just so you could tell others to get you coffee in the morning. Sometimes you should be the one that visits with coffee.

My way or the highway is overrated.
Listen to suggestions from others, no matter their ?rank? in the organization. Several years ago, when the economy was beginning to drop, businesses stopped catering and planning events to save money. Tasty Catering was experiencing a significant reduction in business. It appeared to the leadership team that we would have to let a handful of employees go in order to survive financially. After speaking with the kitchen staff about the upcoming changes, Maricarmen, our kitchen supervisor, came back to the leadership team with a new idea. The culinary team decided to reduce their weekly hours to incorporate the monetary savings Tasty needed to survive without having to lose five of their co-workers. Maricarmen had also explained that this action would save the company more than they were looking for, the reduction in hours was savings equivalent to seven positions. It was a beautifully endearing?and successful?idea, and today we still have those employees.?

Social and emotional wellbeing key to giving vulnerable children ...

NICE is today (24 October) publishing new guidance on the social and emotional wellbeing of vulnerable childreni under 5. The recommendations cover home visits, early education and childcare for vulnerable children.

The guidance recognises that disadvantage before birth and in a child's early years can have life-long, negative effects on health and wellbeing. It aims to ensure that both universal and more targeted services provide the additional support all vulnerable children need to ensure their mental and physical health and wellbeing. Children living in disadvantaged circumstances are more likely to experience social, emotional and behavioural difficulties, and as a result, poor health, education and employment outcomes. For example, measures of ?school readiness'ii show that the poorest 20% of children are more likely to display conduct problems at age 5, compared to children from more affluent backgroundsiii. Local early interventions that support and protect vulnerable children's social and emotional wellbeing are crucial to ensure their healthy development, capacity to learn and achieve at school.

Recommendations include:

? Each health and wellbeing boardiv should ensure that the social and emotional wellbeing of vulnerable children features in its ?Health and wellbeing strategy', as one of the most effective ways of addressing health inequalities.

The resulting plan should include outcomes for ensuring healthy child development and ?readiness for school' and for preventing mental health and behavioural problems.

  • Health professionals in antenatal and postnatal services should identify factors that may pose a risk to a child's social and emotional wellbeing. These include factors that could affect the parents' capacity to provide a loving and nurturing environment. For example, they should discuss with the parents any problems they may have in relation to the father or mother's mental health, substance or alcohol misuse, family relationships or circumstances and networks of support.
  • Health visitors or midwives should offer a series of intensive home visits by an appropriately trained nurse to parents assessed to be in need of additional support. The trained nurse should visit families in need a set number of times over a sustained period of time (sufficient to establish trust and help make positive changes).
  • Health visitors or midwives should consider evidence-based interventions such as baby massagev and video interaction guidancevi to improve maternal sensitivityvii and mother-infant attachment. (For example, this might be necessary when the mother has depression or the infant shows signs of behavioural difficulties.)
  • Local authority children's services should ensure all vulnerable children can benefit from high quality childcare outside the home on a part- or full-time basis, and can take up their entitlement to early childhood education where appropriate. Attendance times should be flexible so that parents or carers have the opportunity to take up education, training or employment opportunities. Such services should also address any barriers that may hinder participation by vulnerable children such as geographical access, the cost of transport or a sense of discrimination and stigma.

Professor Mike Kelly, NICE Director of Public Health, said: ?We know that there are a complex range of factors that impact upon the social and emotional development of children. While most parents offer love and stability to their children, regardless of their personal circumstances, in some cases, children living in challenging environments can experience emotional and behavioural problems. These can have a life-long, negative effect on their future health and wellbeing. NICE is pleased to publish this guidance which will help all those involved in delivering excellent services to the children and their parents who need them most.?

Catherine Law, Professor of Public Health and Epidemiology, University College London Institute of Child Health, and Chair of the Public Health Interventions Advisory Committee at NICE, said: ?This new guidance includes a number of important recommendations that put the social and emotional wellbeing of vulnerable children at the very heart of early intervention services to ensure all children have a fair chance to be healthy and to succeed. The recommendations are based on the best available evidence, and will particularly help to strengthen home visiting and early education services.?

Bren McInerney, Community member of the Public Health Interventions Advisory Committee at NICE, said: "This guidance is a fantastic opportunity to look at how we achieve the very best social and emotional wellbeing of all children and families, particularly those in vulnerable and disadvantaged circumstances. The recommendations set out how health and social care professionals, as well as parents and families, can work together to secure the very best care and services for those under 5 years old. By implementing the guidance at all levels, and including children and families in a meaningful way, we can give all children a fair and equal start in life.?

Simon Antrobus, Chief Executive at Addaction said: ?Addaction fully supports this new guidance. We know that timing is hugely important when helping vulnerable children - and we know that any support on offer must take into account the whole family, and not just the child. We recently published a report looking at this very issue. It proved that well timed, family-based interventions were the most effective way of tackling an 'intergenerational cycle of addiction', where children whose parents use drugs go on to develop their own problems later in life.

?We need to ensure that decision makers understand the importance of this kind of high quality, specialist support. Not only does it work - it is the best way of preventing other problems and giving children the best possible start in life.?

i. The term ?vulnerable' is used to describe children who are at risk of, or who are already experiencing, social and emotional problems and who need additional support.

Vulnerable children include those who are exposed to:

  • parental drug and alcohol problems
  • parental mental health problems
  • family relationship problems, including domestic violence

Vulnerable children may also include those who are in a single parent family or who were born to mothers:

  • aged under 18
  • with a low educational attainment

vii. Maternal sensitivity defines the mother's availability and alertness in well-timed responses to the child's signals, consistently and appropriately, which increase the child's comfort and attentiveness and reduces his/her distress.

About the guidance

1. The Department of Health (DH) asked the National Institute for Health and Clinical Excellence (NICE) to produce this guidance.

2. NICE public health guidance is not statutory, but the NHS, local authorities and the wider public, private, voluntary and community sectors are expected to follow it.

3. NICE public health guidance applies to England only.

4. Most parents living in poor social circumstances provide a loving and nurturing environment, despite many difficulties. However, children living in a disadvantaged family are more likely to be exposed to adverse factors such as parental substance misuse and mental illness, or neglect, abuse and domestic violence. Consequently, they are more likely to experience emotional and behavioural problems that can impact on their development and opportunities in life (Farrington et al. 2006; Shonkoff and Phillips 2000). 5. For the purposes of this guidance, the following definitions are used:

  • social wellbeing - child has good relationships with others and does not have behavioural problems, that is, they are not disruptive, violent or a bully.
  • emotional wellbeing - this includes being happy and confident and not being anxious or depressed.
  • psychological wellbeing - this includes the ability to be autonomous, problem-solve, manage emotions, experience empathy, be resilient and attentive.

6. The guidance is aimed at all those responsible for ensuring the social and emotional wellbeing of children aged under 5 years. This includes those planning and commissioning children's services in local authorities (including education), the NHS, and the community, voluntary and private sectors. It also includes GPs, health visitors, midwives, psychologists and other health practitioners, social workers, teachers, and those working in all early years settings (including child minders and those working in children's centres and nurseries). The guidance may also be of interest to parents, other family members and the general public.
